The Doctor in Yellow, LLC (hereafter referred to simply as “The Doctor in Yellow”) remains committed to ensuring the privacy of all users and visitors (collectively, “users”) of its website. Protecting users’ privacy—especially when considering the personal nature of the services rendered through use of this website—is paramount.

I. Site Analytics & Cookies

In keeping with industry standards of website operation and domain management, The Doctor in Yellow collects non-personally identifiable information (non-PII) generated automatically upon users’ navigation to and between website pages. Non-PII includes dates and times of website visitation, users’ browser type, users’ country of operation, language preferences, time spent viewing website pages, and engagement with interactive elements (i.e. buttons and links). Non-PII is collected and reviewed only for the purpose of understanding the nature of users’ interaction with the website to inform website changes and enhancements. The Doctor in Yellow does not share this non-PII with any other entity or individual unless in a case outlined in subsection “Data Protection.”

Users have a degree of autonomy to control the website’s automated use of non-PII, commonly known as “cookies.” In compliance with the European Union’s General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) of the United States, users who visit The Doctor in Yellow’s website are presented with a notice prompting the selection of their data-collection preference.

II. Personally Identifiable Information

Personally identifiable information (PII) is collected by The Doctor in Yellow in two ways:

  1. Automatic Processes: PII collected automatically includes only users’ IP addresses.

  2. User-Provided Information: Users may provide The Doctor in Yellow with PII including legal first and last names, email addresses, and inquiry details using either built-in website forms or company email addresses. Users are under no obligation to provide this information, but acknowledge that their use of the services provided by The Doctor in Yellow may be limited if certain PII is not provided. PII is used by The Doctor in Yellow only insofar as it is necessary to deliver services or address inquiries. The Doctor in Yellow does not share PII with any other entity or individual unless in a case outlined in subsection “Data Protection.”

III. Data Storage

Non-PII collected as a result of users’ website interaction is stored in disaggregated form for a period not exceeding 30 days from the date of each website visit. Beyond this 30-day mark, data is stored in aggregate form for one year to facilitate ongoing analytics.

PII voluntarily provided by users to The Doctor in Yellow is retained for three years in the following instances (Category A):

  • The user sends The Doctor in Yellow an email or form submission; the content of the email or message, including its associated email address, is stored.

  • The user purchases a reading service; the content in the query field entered at the time of checkout is stored.

In both of these cases, PII is temporarily retained for the purpose of facilitating ongoing client relationships and providing superior service. However, communications (emails and other text-based messages) may be stored indefinitely as informed by a litigation hold if their content pertains to a dispute, complaint, or legal concern (Category B). Users may request the deletion or provision of Category A communications prior to the three-year deletion schedule by sending a request to keiraj@thedoctorinyellow.com. Category B communications are ineligible for deletion upon user request.

IV. Data Protection

The Doctor in Yellow makes all reasonable efforts to protect user data and does not share it in aggregated or disaggregated form with the exception of the following cases:

  • PII is shared with third-party payment processing services (e.g. Stripe and PayPal) to enable website transactions. Third-party payment processors used by The Doctor in Yellow maintain strict data-protection standards when handling client PII and payment information as required by the payment card industry data security standard (PCI DSS).

  • PII is shared with law enforcement and forensic investigators upon request to comply with efforts to facilitate the ongoing investigation of criminal activity. The credentials of any law enforcement agent or representative are vetted for authenticity before PII is shared.

V. Transfer of Ownership

In the event that The Doctor in Yellow is acquired by another entity or has its ownership transferred to another individual or entity, user data—in its being regarded as a business asset—would be transferred as well. Users acknowledge the potential for such a transfer or acquisition to occur, and that the new owner(s) of the business would thereafter have the autonomy to use stored data in accordance with this privacy policy and/or in accordance with amendments made to this privacy policy by the new owner(s).

VI. Privacy Policy Updates

The Doctor in Yellow reserves the right to update this privacy policy on an ongoing basis as business needs and regulations change. Any changes will be reflected on the website immediately, accompanied by an update to the “Last Updated” field at the top of the policy’s page. Use of the website or its services following an update to the privacy policy is considered to be both knowledge and acceptance of the policy’s amendments.
